Suit Dismissed Against NAPR and Glehan

After several months of litigation, Joseph Goddard and Goddard Healthcare Consulting, Inc. have voluntarily dismissed their lawsuit, with prejudice, against NAPR and Ethics Chair, Richard Glehan. Plaintiffs had filed suit in federal court in Texas alleging defamation, and had sought substantial damages. At issue was the publication in NAPR's newsletter of the sanctions recommended by NAPR's ethics committee and approved by NAPR's board of directors. Within the last few weeks of the discovery period, Plaintiffs, without explanation, voluntarily dismissed their case with prejudice, foreclosing any future suit on the same subject matter.

Dear Miss Deed:
I own a recruiting firm and made a candidate referral to another firm for the purpose of splitting a fee (we have a written agreement). The other firm took my referral and presented the candidate to her client, but nothing came of it. Shortly thereafter, I was talking to my contact in the other firm and she thanked me for the referral but agreed it was disappointing not to make the placement. In the course of our conversation she told me that she asked my candidate if he knew of any other doctors interested in the practice. My candidate gave two names, one of which was referred to the client and ultimately accepted the job.
I was upset and demanded a split payment. Doesn’t she owe me a fee and can I file an Ethics Complaint?

Dear Betrayed:
The answers are “no” and “no.” The old Code of Ethics did not address this issue but the new Code does.
Your right to a split fee extends only to the placement of the candidate you specifically referred. If the firm receiving the candidate referral asks that candidate for names of other candidates you have no proprietary right to them. You had the option to ask your candidate for other possible candidates and evidently overlooked this option.
Unfortunately for you, you cannot file an Ethics Complaint for your omission or oversight. I suspect in the future, you will include the “who else do you know?” question in your repertoire.
