  • The 2004 Annual Convention will be held April 21-24 in San Diego at the Loews Coronado Bay Resort. We have finalized the speakers and schedule for the upcoming convention in San Diego. We are extremely proud and excited of the convention we have put together. Most importantly, the thing I would like to emphasize the most is the topics and presentations. Fantastic lineup and really, really great subjects. I think it will be hard to choose which ones to go to of the concurrent sessions. Secondly, San Diego and the Loews is a beautiful property so rather than put some presentations on Saturday, we have fun networking opportunities such as a Mexico shopping trip, San Diego Zoo visit, or a Golf outing! Finally, it will be the 20th anniversary celebration and everyone will be there having lots of fun!
    - Mike Broxterman, Convention Committee Chair

Thank You to our Vendors and Exhibitors

As we prepare for our Annual Convention in San Diego, we want to again thank our Vendor/Exhibitors for their past and present support of our association. With their generous sponsorship of our receptions, breakfasts, luncheons, breaks and speakers, it helps keep our costs lower enabling more members to attend. It is a win/win for all involved. This in turn allows our vendors to showcase their products and services to more firms and we as members obtain valuable information from companies that can help us be more successful in our day to day operations. Our vendor/exhibitors include companies involved in relocation, medical journals and publications, mailing lists, attorneys, software companies, website design, background checks, physician and nurse licensing, and internet job boards. If you know of a company who may be interested in becoming a Vendor/Exhibitor member, please contact NAPR headquarters or Vendor Chair, Joan Pearson at 800-657-0354.

Medical Students Say Malpractice Issues Are Affecting Career Decisions

An AMA survey found that roughly half of the nation’s medical students consider medical liability problems when choosing a specialty, while 39% choose states where they intend to practice based on similar considerations.

Almost two-thirds of medical students responding to the survey (74%) said they were very or somewhat familiar with problems related to escalating malpractice premiums.

Surveyed medical students identified several specialties as high risk, including emergency medicine, ob/gyn and general surgery. Respondents also identified 19 states as “crisis states” because of their medical liability problems.

Thirty eight percent of medical students said their professors had discussed medical liability concerns with them. Specific topics of conversation included increasing liability premiums, the practice of defensive medicine, and which areas of the country faced the most severe liability problems.

The survey, which was conducted in the middle of last year, gathered responses from almost 4,000 students.

NAPR Ethics Committee
Richard Glehan, Ethics Committee Chairman

The current Ethics Committee is comprised of a chairperson and 10 members. The Committee members include the President of the NAPR, and represent both firms and inhouse recruiters. When a formal complaint is filed, a member of the Committee is assigned as the investigator and attempts to elicit information from both the complainant (the organization filing the complaint) and the respondent (the organization against which the complaint was filed). The facts are presented to the Committee and a recommendation is made as to the validity of the complaint. Sanctions are then imposed which can range from a Caution to Expulsion.

From January through December of 2003, a total of 37 issues were reviewed; 8 complaints were filed and adjudicated; 18 additional complaints were made but were never formally filed and 9 inquiries were made to solicit advice on various topics such as appropriate referrals and procuring cause. Of the 8 complaints decided by the Ethics Committee, one was appealed to the Board of Directors of the Association which upheld the Ethics Committee’s decision.

Because changes in the Code of Ethics, approved by the NAPR membership in April 2003, require that the name of any firm sanctioned for Probation for a period of 6 months or more, be published in the next regularly scheduled NAPR Newsletter to the membership, one organization had its name published during the year 2003.

The role of the Ethics Committee is to educate. Our members have agreed to the Code of Ethics and Standards of Practice and Procedures for Professional Conduct as a condition of membership. The Association encourages calls to NAPR Headquarters (407-774-7880) or to the Chair of Ethics (203-778-3333) for advice and/or consultation.

How to Get a Good Seat on an Airplane

Has your company recently cut back on travel expenses? Are you being asked to use the lowest fares available? Here are some tips on getting a comfortable seat on a plane, no matter what fare you pay:

  • Boeing 747s, 767s, 777s or Airbus A-340s are wider planes and will give you more comfort on long flights.
  • Avoid smaller aircraft for flights that are longer than one and a half to two hours.
  • The best seats on a plane are the ones closest to the front, farthest from the lavatory or galley, and with a good view of entertainment screens.
  • Check out www.seatguru.com, which ranks the seats on most major airlines.

Discrimination by Sex or National Origin

The NAPR is the premier physician recruiting association in the US and for that matter the world. Because of our pre-eminent status, the Association monitors the ads placed on the World Job Bank to ensure that the phrasing is in compliance with the laws of our country. As a note of interest…some of our current World Job Bank ads are borderline discriminatory.

Certain sentences and/or phrasing was taken from the listed ads and given to NAPR attorney. She provided a general a general guideline as well as a response to the individual phrases which follow below:

"Other than a small exception for bona fide occupational qualifications, it would violate anti-discrimination laws to advertise a position and to list and/or suggest a preference, limitation, or specification based on a legally protected characteristic such as sex or national origin. Thus, stay away from the gender issue in any ads.

The national origin question is a little harder. To advertise for only American medical school grads and trainees is getting dangerously close to the line. Obviously, you could assert that this requirement applies regardless of an applicant's national origin (including American). But, it definitely would weed out far more applicants who are not American. (Also, it would mean you could not consider someone who went to school at Oxford.) It would be better to let everyone apply and then sort out the most qualified. That way, a red flag is not raised, and you can then make the decision based on a number of factors including, among other things, quality of education."

Is This Gender Discrimination?

Phrase: "Join 4 female physicians in established private practice…"
Attorney: No, as this simply advises the sex of the current women. However, it would be better not to advertise the gender because it is a fine line.

Phrase: "Because there is no female OB in the community, females are encouraged to apply."
Attorney: Yes

Phrase: "Join an all female private practice."
Attorney: Yes

Phrase: “Thriving practice of 4 female MDs looking to add another.”
Attorney: Yes

Phrase: "Join a busy group of 7 female OBs…"
Attorney: Better not to advertise gender.

Phrase: "All female group…"
Attorney: Yes

Phrase: "Join an all female group of OB/GYNs…"
Attorney: Yes

Is This Nationality Discrimination?

Phrase: "Client prefers American Medical Trained physicians…"
Attorney: Technically no, but I advise not to advertise as such.

Phrase: "Medical Health Center in seeks a board certified/eligible American trained general surgeon to join a group of 3 other general surgeons."
Attorney: Technically no, but I advise not to advertise as such.

Phrase: "Multi-specialty group seeking American trained OB/GYN for offices."
Attorney: Technically no, but I advise not to advertise as such.

Phrase: "Qualifications are BE/BC, MD or DO, all American training, state licensed or in process…"
Attorney: Technically no, but I advise not to advertise as such.

Phrase: "American trained candidates only."
Attorney: Technically no, but I advise not to advertise as such.

Phrase: "If you have stellar American training…"
Attorney: Technically no, but I advise not to advertise as such.

Phrase: "All American Medically Trained."
Attorney: Yes

Phrase: "Will look at either DO or MD, either BE or BC, must be AMT."
Attorney: Yes

Phrase: "He/she needs to be board certified in Family Practice and be all American Trained (including medical school)."
Attorney: Yes

Phrase: "American Medical School trained physicians who are MD's or DO's who have done an allopathic residency program."
Attorney: Yes

Phrase: "Must be BC/BE American or Canadian trained MD."
Attorney: Yes
