It is no secret that the legislation passed over the last several months has brought some significant changes to communication patterns in our industry. In an effort to keep membership informed and able to make the decisions that will impact our businesses, NAPR has sought legal advice. Legislative Committee Chair Rich Cornell, Mike Broxterman and I have held several conference calls with Attorney Jason Gamel of Baker & Hostetler, LLP. We oriented Jason to the physician recruitment industry, to the general patterns of communication and to the questions that have been raised by our members.
Mr. Gamel has prepared a memo reviewing the communication laws that may directly affect how we conduct our business. As this Newsletter is going to press, this document is being mailed to all active and vendor members of NAPR. It is a comprehensive report reviewing the Telephone Consumer Protection Act (TCPA), the Can-Spam Act and a brief review of the Do Not Call regulations.
The TCPA legislation is the federal law enacted in 1991 that regulates unsolicited facsimile transmissions. Two member firms have been threatened with law suits in the past two years after sending facsimiles to market candidates. It is in your best interest to familiarize yourself with these laws, both federal and state. This document provides a brief review of the federal law and of each state with legislation pertinent to unsolicited facsimile transmission. Please note the federal TCPA laws apply in addition to each state’s local law. If your state or states in which you do business are not included in this report, the federal TCPA laws still apply.

Your brief note raises some very significant issues which may potentially create significant liabilities for you.
First, in accordance with the Code of Ethics, you are required to maintain an accurate tracking system to record the submission of candidates. If you keep a log book, you will immediately know if the candidate referral is valid and can instantly (although you officially have five days to notify the recruiter) notify the firm of the validity of the referral.
Second, if you accept non-verbal referrals, you must be sure that the recruiter is, in fact, the procuring agent and that he or she has described your practice opportunity and received permission from his or her candidate to submit the candidate’s curriculum vitae.
Third, you should prepare a postcard (or e-mail/fax paragraph) which is sent to any firm which improperly presents a candidate to you. If you are diligent about this notification you will avoid the possibility of having to pay two fees. If you choose to ignore a referral which is either inappropriate or a duplicate, you will find that your non-response, in essence, constitutes an acceptance of the candidate referral.
Lastly, update your contracts with recruiting firms every two to three years. This will enable you to terminate relationships that proved to be contentious, irritating or unproductive.
Your future efficiency will be a recruiter’s dream. It’s so much easier to establish and enforce rules for how you want recruiters to work with you than to be a goody-two-shoes’ person who tries to please all. You will lose the good and honorable recruiters while encouraging the low-lifes and bottom-feeders.
Now get your bony bottom into gear, recover your sanity and remember my definition for organization: something you did without before you got it, but by that time it has become a necessity. Got that?…Really?

Her employment with SLACK Incorporated began in 1999 and she has steadily increased responsibilities, most recently being promoted to Sales Director of Recruitment / Classified Advertising. Prior to joining SLACK, Kristy was employed as a sales support administrator for an industrial pump company, Godwin Pumps, based in New Jersey. Prior to her position at Godwin Pumps, she worked as a Front Desk/Sales Manager for the hotel chain, Hampton Inn.
